Proposals are rules that have been approved by the commissioners to be published in the Texas Register for public comment.

 

PROPOSALS are rules that have been approved by the commissioners to be published in the Texas Register for public comment. The public comment period usually lasts for 30 days after the publication date. After the public comment period has closed, staff evaluates all comments and makes appropriate changes to the proposed rule. The draft adoption is then filed with the Chief Clerk and moved to Pending Adoptions.

2017-034-295-OW HB 1600 and SB 567 (83rd), HB 1648, HB 3735, SB 864, SB 1430 (85th): Water Rights - Expedited Amendments, Notice, & Conservation, and PUC Transfer
The proposed rulemaking would implement HB 1600 and SB 567, 83rd Texas Legislature, 2013, to amend requirements related to the transfer of the utilities and rates program to the PUC. The proposed rulemaking would also implement HB 1648, HB 3735, SB 864, SB 1430, 85th Texas Legislature, 2017, to amend requirements relating to certain retail public utilities and their designation of a water conservation coordinator; amend specific map requirements and to codify the commission's practice regarding consideration of the public welfare in water rights applications; amend notice requirements relating to alternate sources of water used in water rights applications; and amend provisions relating to applications to change the diversion point for existing non-saline surface water rights when the applicant begins using desalinated seawater.

2017-009-305-OW Dental Office Pretreatment Standards (40 CFR Part 441) Adoption by Reference
The rulemaking would amend 30 TAC §305.541 to adopt by reference 40 Code of Federal Regulations Part 441 as published on June 14, 2017, in the Federal Register (82 FedReg 27154 - 27178) and minor corrections to the rule that were published in the Federal Register on June 26 and July 5, 2017 (82 FedReg 28777; 82 FedReg 30997). The proposed rulemaking would also adopt by reference the United States Environmental Protection Agency's Effluent Limitations Guidelines and Standards for the Dental Category.

2016-019-334-CE HB 7 (84th), SB 1557 (85th), and Implementation of Federal Petroleum Storage Tank Rule Updates
This rulemaking will implement HB 7, 84th Legislature and SB 1557, 85th Legislature and will also incorporate any necessary changes to 30 TAC Chapter 334 in accordance with the 2015 revisions to the federal petroleum storage tank regulations in 40 CFR Part 280. Additionally, this rulemaking will allow TCEQ to reapply for state program approval from the EPA.

2017-030-114-AI SB 1731: Light-Duty Motor Vehicle Purchase or Lease Incentive Program
The rulemaking would propose revisions to the standards and criteria for the Light-Duty Motor Vehicle Purchase or Lease Incentive Program in order to implement legislation that re-establishes the program. The revisions would include maximum incentive amounts of $5,000 for natural gas and propane vehicles and $2,500 for electric vehicles, with a limit per fiscal biennium of 1,000 incentives for natural gas and propane vehicles and 2,000 incentives for electric vehicles. The revisions would also allow vehicles converted to operate on natural gas or propane within 500 miles of first sale of the vehicle to be eligible for an incentive.

2017-031-114-AI SB 1731: Texas Emissions Reduction Plan (TERP) Programs
The rulemaking would propose revisions to the standards and criteria for incentives under the Diesel Emissions Reduction Incentive Program, Texas Clean School Bus Program, Texas Clean Fleet Program, and Drayage Truck Incentive Program, including changing the name of the drayage program to the Seaport and Rail Yard Areas Emissions Reduction Program. The rulemaking would implement legislation that amended statutory provisions for these programs.
