McNabb Flying Service

No further Superfund environmental response actions are required at this former aerial pesticide applicator company in Alvin, Brazoria County. This site was referred to the Voluntary Cleanup Program.

Site Background

The McNabb Flying Service state Superfund site is located 1.5 miles northwest of the city of Alvin, approximately 1 mile east of State Highway 6, at the intersection of Brazoria County roads 146 and 539. The site was identified as a potential hazardous waste site by the EPA in October 1984 from Texas Department of Agriculture files. The site had been used as an aerial pesticide applicator service. A preliminary assessment in January 1985 noted that the site had been inactive for more than 10 years. In 1988, the EPA issued a recommendation that no further remedial action was planned, however, a removal action was suggested and the site was referred to the Texas Water Commission on September 27, 1988. TNRCC investigators found approximately 90 drums, cans, containers and bottles or jugs that had contained pesticides or other chemicals. Some of the drums were rusted and leaking onto the earthen floors of the hangars. TNRCC determined that the site was eligible for Superfund cleanup action as an inactive facility. Approximately 1,500 square feet of soil was impacted, mostly the earthen floor inside the hangars.

Superfund Actions Taken to Date

  • August 8, 1999, TNRCC conducted a removal action of wood debris and empty drums to clear a path to the stored pile of containers of unidentified liquids, solids and sludges, which were to be analyzed and categorized for safe handling and disposal.
  • August 1999, a copy of the hazard ranking system (HRS) documentation record was prepared for the McNabb Flying Service site.
  • November 8, 1999, a legal notice was published in The Alvin Sun, describing the site, proposing the site to the state Superfund registry, and setting December 13, 1999 as the deadline for a request for a public meeting, or to receive written citizen comments on the proposed listing.
  • November 12, 1999, a November 12, 1999, a legal notice was published in the Texas Register (24 TexReg 10233), describing the site, proposing the site for listing on the state Superfund registry, and setting December 13, 1999 as the deadline for a request for a public meeting, or to receive written citizen comments on the proposed listing.
  • January 19, 2000, after analysis, the remaining waste material, consisting of small
    quantities of solvent, water-based pesticides, miscellaneous cans of paint and paint thinners, two charged gas cylinders, several lead-acid batteries, and all used sampling equipment, was grouped into six waste categories and was removed from the site.
  • March 4, 2000, TNRCC issued a remedial investigation work order to determine the nature and extent of contamination.
  • March 15, 2000, a community relations plan was prepared for the McNabb Flying Service site.
  • September 9, 2000, a potentially responsible party notified TNRCC of their intent to investigate the site under the Voluntary Cleanup Program (VCP).
  • March 5, 2001, TNRCC Voluntary Cleanup Program received the application from the potentially responsible party.
  • June 18, 2001, the TNRCC Voluntary Cleanup Program completed the review of the application and assigned a project number: VCP 1321.
  • August 2, 2001, the TNRCC Voluntary Cleanup Program signed an agreement with the potentially responsible party to investigate and clean up the site.
  • September 1, 2002, effective date of the name change from Texas Natural Resource Conservation Commission (TNRCC) to Texas Commission on Environmental Quality (TCEQ).
  • April 4, 2005, a legal notice was published in the Alvin Sun, proposing to delete the McNabb Flying Service site from the state Superfund Registry in accordance with 30 TAC §335.344(c). The site has been accepted into the Voluntary Cleanup Program. A public meeting will be held May 26, 2005 at the Texas Commission on Environmental Quality, 12100 Park 35 Circle, Building D, Room 200-33, Austin.
  • April 8, 2005, a legal notice was published in the Texas Register, (30 TexReg 2113), proposing to delete the site from the state Superfund Registry. The site has been accepted into the TCEQ Voluntary Cleanup Program and is therefore eligible for deletion as provided by 30 TAC §335.344(c). A public meeting will be held May 26, 2005 at the Texas Commission on Environmental Quality, 12100 Park 35 Circle, Building D, Room 200-33, Austin.
  • May 26, 2005, a public meeting was held at the Texas Commission on Environmental Quality in Austin to receive public comment on the proposal to delete the site from the Superfund registry. The site has been accepted into the TCEQ Voluntary Cleanup Program and is eligible for deletion as provided by 30 TAC §335.344(c). No challenges were received to the proposal to delete.
  • July 22, 2005, a legal notice was published in the Texas Register, (30 TexReg 4239), officially deleting the site from the state Superfund registry in accordance with 30 TAC §335.344(c) and 30 TAC §361.189(a). The site was accepted into the Voluntary Cleanup Program. In accordance with Texas Health and Safety Code §361.188(d), a notice will be filed in the real property records of Brazoria County stating that the site has been deleted from the Superfund registry.
