The Legal Authority for the Remediation Contracting Program

The Remediation Contracting Program is authorized to procure contracts for the purposes of investigation, assessment, and cleanup activities at remediation sites under a variety of state mandates and federal laws.

State authority to perform investigation and cleanup activities at remediation sites are contained in the Texas Health & Safety Code, Chapter 361

Federal authority to perform investigations, hazardous immediate removals, assessments, and cleanup activities at Superfund and voluntary cleanup/brownfields sites are contained in Federal 42 U.S.C. 9604 et. Seq. (CERCLA).
