General Permit Requirements to Discharge Water from Petroleum Bulk Stations and Terminals

Requirements for obtaining coverage under General Permit TXG340000 to discharge facility wastewater, contact stormwater, and stormwater associated with industrial activities from petroleum bulk stations and terminals (PBSTs) into or adjacent to water in the state

The TCEQ renewed the Texas Pollutant Discharge Elimination System General Permit TXG340000 effective October 24, 2022. ( Fact Sheet)

Before you discharge facility wastewater, contact stormwater, or stormwater associated with industrial activities from a PBST into or adjacent to water in the state, you must:

A. Review your facility's compliance history ranking:

  • If your facility has a ranking of "high," "satisfactory," or "inadequate information" you may qualify for coverage under this general permit.

  • If the compliance history ranking is "unsatisfactory," then you must apply for an individual permit instead.

B. Read the general permit to determine if it applies to your facility. If the general permit does not apply, you may need to obtain an individual permit. If it does apply, you must submit a notification package which includes:

Provisional coverage under this general permit begins 48 hours after the NOI is postmarked for delivery to TCEQ.

After TCEQ review, you will receive one of the following:

  • An Acknowledgment Letter providing authorization for coverage,

  • A Notice of Deficiency (NOD), requesting additional information with 30 days to respond;

  • A Denial Letter informing you that coverage has been denied (usually the result of information requested in the NOD not being provided).

After obtaining coverage under this permit, you will need to do the following:

  • Adhere to the requirements of the general permit (TXG340000).

  • Complete and submit the Discharge Monitoring Report Form (3320-1), as required.

  • Submit a Notice of Termination (NOT) if the facility owner or the operator changes, or if the discharge is completed, or delayed, or becomes unnecessary. The permit is in effect until the NOT is submitted. Annual Water Quality fees will accrue each year on September 1.

NOTE: If you are discharging to an MS4 (HTML), you must submit a copy of the NOI, NOC, and/or NOT to the operator of that system at the same time submittal is made to the TCEQ.
