General Permit TXR040000 for Phase II (Small) MS4s

Requirements for obtaining authorization for stormwater discharges from small MS4s, the new General Permit, forms and annual reporting.

TCEQ is in the process of renewing the TPDES Phase II Municipal Separate Storm Sewer System (MS4) General Permit, TXR040000, which expires on January 24, 2024. Because of a delay in the Texas NeT-MS4 System set-up, TCEQ is delaying the renewal of the Phase II MS4 General Permit until August 2024. Small MS4 operators with active authorizations will be granted administrative continuance of their existing authorization until the renewal permit is issued in August 2024. During administrative continuance, TCEQ cannot process any notice of change requests. Existing small MS4 operators must continue to implement ongoing items in their most recently TCEQ approved stormwater management program until new authorizations are issued under the 2024 renewal permit. New small MS4 operators will be unable to seek coverage until the Phase II MS4 General Permit is renewed in August.

TCEQ published  notice of the proposed 2024 MS4 General Permit in the Texas Register and Houston Chronicle newspaper. The proposed general permit and fact sheet were made available for review as part of the 30-day public comment period which ended on September 25, 2023.

Following the issuance of the public notice, TCEQ identified a necessary change in the comment period end date. On August 30, 2023, TCEQ issued Errata for the Phase II MS4 General Permit Renewal and Public Meeting Notice issued on August 18, 2023, to clarify the identified errors. The public comment period end date was extended to September 25, 2023.

2019 General Permit for Small MS4s

The Small MS4 General Permit, TPDES Permit No. TXR040000, was issued on January 24, 2019. It authorizes the discharge of stormwater to surface water in the state from small municipal separate storm sewer systems (MS4s).
