- Docket No. 1998-1154-EXE. The Commission will meet in closed session to deliberate the
appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of the
Commission's Executive Director, as permitted by Section 551.074 of the Texas Open Meetings Act,
Chapter 551 of the Government Code. The Commission may also meet in open session to take
action on this matter as required by Section 551.102 of the Texas Open Meetings Act, Chapter 551
of the Government Code.
No action taken.
- Docket No. 1999-0024-EXE. The commission will conduct a closed meeting to receive legal advice
and will discuss pending or contemplated litigation, settlement offers, and/or the appointment,
employment, evaluation, reassignment, duties, discipline or dismissal of specific commission
employees, as permitted by Sections 551.071 and 551.074, the Open Meetings Act, codified as
Chapter 551 of the Government Code. The Commission may also meet in open session to take
action on a legal or personnel matter considered in the closed meeting as required by Section
551.102 of the Texas Open Meetings Act, Chapter 551 of the Government Code.

- Docket No. 1999-0025-EXE. The commission will conduct a closed session to discuss their duties,
roles, and responsibilities as commissioners of the TCEQ pursuant to section 551.074 of the open
meetings act, codified as chapter 551 of the government code. The Commission may also meet in
open session to take action on this matter as required by Section 551.102 of the Texas Open
Meetings Act, Chapter 551 of the Government Code.

Docket No. 2003-0169-RUL. Consideration of the adoption of the rules review and readoption
of 30 TAC Chapter 324, Used Oil Standards. This review is in accordance with Texas
Government Code, Section 2001.039, which requires state agencies to review and consider for
readoption each of their rules every four years. The proposal was published in the March 21,

readoption of 30 TAC Chapter 308, Criteria and Standards for the National Pollutant
Discharge Elimination System. This review is in accordance with Texas Government Code,

of their rules every four years. The proposal was published in the March 21, 2003 issue of

readoption of 30 TAC Chapter 210, Use of Reclaimed Water. This review is in accordance
with Texas Government Code, Section 2001.039, which requires state agencies to review
and consider for readoption each of their rules every four years. The proposal was
published in the March 28, 2003 issue of the Texas Register (28 TexReg 2747). (Clifton

readoption of 30 TAC Chapter 312, Sludge Use, Disposal, and Transportation. This review
is in accordance with Texas Government Code, Section 2001.039, which requires state
agencies to review and consider for readoption each of their rules every four years. The
proposal was published in the March 21, 2003 issue of the Texas Register (28 TexReg 2624).

Consideration of legislative issues potentially affecting the TCEQ and actions taken
by the Texas Legislature. The commission may consider legislative proposals and
approve recommendations for changes to statutory provisions. The commission
may also meet in closed meeting to receive legal advice regarding these matters, or
any of the above matters, as authorized by Section 551.071 of the Open Meetings
Act, Chapter 551 of the Government Code. Any commission action, decision, or
vote on these matters will be made in open meeting in accordance with Section
551.102 of the Open Meetings Act, Chapter 551 of the Government Code. Randy
Wood, Deputy Director, OEPAA and Steve Minick, Director, Intergovernmental Affairs Division
presented this issue. Steve provided an summary of legislative bills affecting the agency.
Overall there are approximately 41 bills which will result in rulemaking and 46 bills which will
require administrative projects to implement. These numbers are approximately one half the
number of rules and projects resulting from the previous legislative session. Approximately 18
bills have a shortened time frame for implementation.

Planning for the next Commissioners' Work Session. The next work session is scheduled for
July 25. New items tentatively identified for discussion are technical and historical issues
relating to instream flows, preliminary FY04 budget, ECOS fall meeting agenda, 305(b) and
303(d) water quality assessment as well as the standing issues.
