  1. Docket No. 1998-1154-EXE. The Commission will meet in closed session to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of the Commission's Executive Director, as permitted by Section 551.074 of the Texas Open Meetings Act, Chapter 551 of the Government Code. The Commission may also meet in open session to take action on this matter as required by Section 551.102 of the Texas Open Meetings Act, Chapter 551 of the Government Code.

  2. Docket No. 1999-0024-EXE. The commission will conduct a closed meeting to receive legal advice and will discuss pending or contemplated litigation, settlement offers, and/or the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of specific commission employees, as permitted by Sections 551.071 and 551.074, the Open Meetings Act, codified as Chapter 551 of the Government Code. The Commission may also meet in open session to take action on a legal or personnel matter considered in the closed meeting as required by Section 551.102 of the Texas Open Meetings Act, Chapter 551 of the Government Code.

  3. Docket No. 1999-0025-EXE. The commission will conduct a closed session to discuss their duties, roles, and responsibilities as commissioners of the TCEQ pursuant to section 551.074 of the open meetings act, codified as chapter 551 of the government code. The Commission may also meet in open session to take action on this matter as required by Section 551.102 of the Texas Open Meetings Act, Chapter 551 of the Government Code.

  1. Discussion of the Enforcement Report for September 2002. Anne Dobbs, OCE/Enforcement presented this issue.

  2. Discussion and Update of the Permit Time frame Reduction (PTR) project for October 2002. Mark Vickery, Deputy Director, OPRR and Dale Beebe-Farrow, Director Water Supply Division presented this issue.

    No action taken.


  3. Docket No. 2002-0940-RUL. Consideration for the adoption of the rules review and readoption of 30 TAC Chapter 291, Utility Regulations. This review is in accordance with Texas Government Code, Section 2001.039, which requires state agencies to review and consider for readoption each of their rules every four years. The proposal was published in the September 6, 2002 issue of the Texas Register (27 TexReg 8617). Joseph Thomas, OEPAA, Irene Montelongo, OPRR, and Todd Burkey, OLS presented this issue.

  4. Discussion of a proposed Research Model to meet the practical regulatory research needs of the TCEQ (Texas Water Code, Chapter 5, §§ 5.1191 - 5.1193; House Bill 2912, § 1.11). Karen Atkinson, Director Strategic Assessment Division, Dave Parmer and Tom Weber, SEA Group presented this issue. Staff will report to the Commission on a regular basis as the Research Model develops.

  5. Discussion of the cumulative risk provisions of House Bill 2912, Section 1.12, 77th Texas Legislature, 2001. Karen Atkinson, Director Strategic Assessment Division, Russ Baier and Tom Weber, SEA Group and Torin McCoy, Toxicology and Risk Assessment Section presented this issue. The Commission charged staff to expand the description of existing practices provided in Appendix A to the backup materials and to develop characteristics of geographic areas where the agency has responded to concentrated operations. Staff will return to work session with appropriate information within the next six months.

  6. Consideration of legislative issues potentially affecting the TCEQ and actions taken by the Texas Legislature. The commission may consider legislative proposals and approve recommendations for changes to statutory provisions. The commission may also meet in closed meeting to receive legal advice regarding these matters, or any of the above matters, as authorized by Section 551.071 of the Open Meetings Act, Chapter 551 of the Government Code. Any commission action, decision, or vote on these matters will be made in open meeting in accordance with Section 551.102 of the Open Meetings Act, Chapter 551 of the Government Code. Steve Minick, IGR, presented this issue, noting that interim reports are being received from Senate IGR. Our IGR staff will prepare summaries of those reports to distribute to the commission prior to the Thanksgiving Holidays.

  7. Planning for the next Commissioners' Work Session.

    The next work session is scheduled for December 6. Currently, only the standing issues are planned for discussion.
