- Discussion of the Monthly Enforcement Report for May 2001. Anne Dobbs,
OCE/Enforcement, presented this issue. No action taken.
- Discussion of Fiscal Year 2002 Operating Budget. Machelle Pharr, CFO, presented this
issue. Staff will return to the August 10th work session with a final budget proposal. No
action taken.
- Consideration for approval to publish and to solicit public comment on the Draft TMDL
for dissolved oxygen in Salado Creek. Chuck Mueller, SIP Section, presented this issue.
The Commissioners' approved the request.
- Consideration for approval to publish and to solicit public comment on the Draft
Implementation Plan for four TMDLs for 1,1-dichloro-2,2-bis(p-chlorophenyl)ethylene (DDE), chlordane, and toxaphene in the Arroyo Colorado and polychlorinated biphenyl (PCB) in the Donna Reservoir. Chuck Mueller, SIP Section, presented this issue. The Commissioners' approved the request.
- Consideration for approval to publish and to solicit public comment on the Draft
Implementation Plan for two TMDLs for chlordane in Clear Creek. Chuck Mueller, SIP
Section, presented this issue. The Commissioners' approved the request.
- Consideration for approval to publish and to solicit public comment on the Draft
Implementation Plan for four TMDLs for the volatile organic compounds (VOCs)
trichloroethane and dichloroethane in Clear Creek. Chuck Mueller, SIP Section, presented
this issue. The Commissioners' approved the request.
- Consideration to approve the Final Implementation Plan for fourteen TMDLs for nickel in
the Houston Ship Channel. Chuck Mueller, SIP Section, presented this issue. The
Commissioners' approved the request.
- Consideration to approve the Final Implementation Plan for eleven TMDLs for legacy
pollutants in streams and reservoirs in Fort Worth. Chuck Mueller, SIP Section, presented
this issue. The Commissioners' approved the request
- Consideration to approve the Final Implementation Plan for a TMDLs for dissolved
oxygen in Lake Austin. Chuck Mueller, SIP Section, presented this issue. The
Commissioners' approved the request.
- Consideration of issues relating to Hazardous Waste Generation Fees. Kari Bourland,
Waste Permits Division and Marilyn Querejazu, Industrial Hazardous Waste Permits Section,
presented this issue. The Commissioners' directed staff to implement Option 1, to Question 1,
as briefed, to expand the current waste generation fee exemption to characteristically hazardous
wastewater hardpiped to a publicly owned treatment works (POTW) for treatment. The
Commissioners' also directed staff to implement Option 1 to Question 2, as briefed, to create a
fee exemption for listed hazardous wastewater generated due to de minimis losses at terminal
facilities, similar to the federal exemption from the definition of hazardous waste for
manufacturing facilities. Rulemaking will follow to implement these changes.
- Consideration of issues related to the implementation of the state's Motor Vehicle
Emission Inspection and Maintenance program by the Texas Natural Resource
Conservation Commission, including inspection station recruitment, legislation passed by
the 77th legislature, and other related issues. Hazel Barbour and Bobby Wierzoweicki,
Mobile Source, presented this issue. The Commissioners' directed staff to develop two
separate rulemakings to the state I/M program. The first rulemaking will address equipment
specifications, fees, incentives, and other items pertinent to HB 2134. The second rulemaking
will address implementation of the low income repair assistance program as established by HB
2134.
- Consideration of legislative issues potentially affecting the TNRCC and actions taken by
the Texas Legislature. The commission may also meet in closed meeting to receive legal
advice regarding these matters, or any of the above matters, as authorized by Section
551.071 of the Open Meetings Act, Chapter 551 of the Government Code. Any
commission action, decision, or vote on these matters will be made in open meeting in
accordance with Section 551.102 of the Open Meetings Act, Chapter 551 of the
Government Code. Julia Rathgeber presented this issue. No action taken.
- Planning for the next Commissioners' Work Session. The next work session is August 10. Topics for this work session include the first I/M rule package, proposed SB 5 guidance, FY
2002 final budget, the ECOS fall meeting, as well as standing items. Discussion items for the
August 23rd work session include work session workload impacts and standing items. The PST
self-certification program and a joint Texas Soil and Water Control Board - TNRCC meeting
are tentatively scheduled for September along with updates on Senate Bill 2, Senate Bill 5, and
House Bill 2912.
