authorize the construction of a 9,072 acre-foot reservoir with a
normal operating elevation of 348.0 mean sea level on the
Naconiche Creek, tributary of Attoyac Bayou, tributary of the
Angelina River, tributary of Neches River, Neches River Basin.
The applicant is requesting that the impounded waters be used for
flood control and recreation purposes in Nacogdoches County,
approximately 13 miles northeast of Nacogdoches, Texas. No
diversion of waters from the reservoir is requested. The
Commission will consider the application and the hearing requests

Docket No. 98-0549-SLG. REYNOLDS METALS COMPANY,
for Permit 03966, for land application of domestic wastewater
treatment plant sludge. Domestic wastewater treatment plant
sludge will be land applied at a rate of 440 Metric Tons per year
(dry weight basis), to approximately 457 acres of closed bauxite
tailing beds to establish vegetation. Domestic sewage sludge from
various sources will be either trucked or piped to an on-site
unloading area. after arrival at the sludge unloading area, the
sludge will be pumped through a series of pipes to a perforated
drainage pipe and allowed to flow across the disposal area. The
leachate from the bauxite tailing beds is allowed to migrate
through a drainage system and ultimately flow into an on-site
liquor pond the water will be reused as process water for the
Reynolds Metals Company Plant. Surface runoff will be contained
by external dikes surrounding the sludge disposal area. No
discharge of pollutants into waters in the State is authorized by the
permit. The facility is located on the south side of State Highway
361, adjacent to its intersection with State Highway 35,
approximately one mile southeast of the City of Gregory, in San
Patricio County, Texas. The Commission will consider the

Docket No. 98-0563-MWD. Request by RAYFORD ROAD
MUD for an amendment of permit (Permit No. 12030-001), to
authorize an increase in the flow of treated domestic wastewater
from a daily average flow of 0.65 million gallons per day (MGD)
to a daily average flow of 0.95 MGD in the Interim II phase and to
an annual average of 1.3 MGD in the Final phase. The applicant is
also requesting a variance to the buffer zone requirements within
the Montgomery County Drainage District No. 6 Channel IIDF in
accordance with 30 TAC Section 309.13(e)(1)(B). This Channel
area is restricted to drainage use exclusively. The applicant is also
requesting a variance to the buffer zone requirements within 150
feet of the proposed Chlorination/ Dechlorination Basin addition
that extends onto adjacent private property in accordance with 30
TAC Section 309.13(e)(1)(C). This variance is based on the fact
that will be no noise and odor nuisance emanating from this basin.
The owner of the property has been previously contacted and has
refused to sell a buffer zone easement to the District. The property
contains a drilling site and is not suitable for residential use. The
plant site is located north of Rayford Road, approximately 2.1
miles east of the intersection of Rayford Road and Interstate
Highway 45 in Montgomery County, Texas. The Commission will
consider the application and the hearing requests that have been

SOLUTIA, INC. for a Temporary Authorization to allow
operation of a new outdoor container storage area to replace the
smaller 100 ton capacity (limited to 400 55-gallon containers)
outdoor container storage area currently authorized under Permit
No. HW-50189-001. The applicant has submitted a permit
renewal application which includes this change as a major
amendment to their permitted activity. The application requests
authorization to increase the storage capacity of the facility's
outdoor container storage area to 1,500 tons of mixed hazardous
waste solids (greater than 25% increase in facility's container
storage capacity) and to store mixed hazardous waste solids in
various and different containers, including roll-off boxes. The
mixed hazardous waste consists of spent carbon and depleted
uranium catalyst sludge. The applicant operates a plant for the
manufacture of chemical feedstocks and intermediates and is
located on Farm-to-Market Road No. 2917, approximately 7 miles
southeast of its intersection with State Highway No. 35 and 14
miles southeast of Alvin, Brazoria County, Texas. The
Temporary Authorization would terminate 180 days from the date
of issuance of the authorization or upon final determination of
TNRCC's review of RCRA permit renewal application

Control Technology (MACT) standards for the control of
hazardous air pollutant emissions from specific source categories.
These five federal rules are Group I Polymers and Resins, 40 Code
of Federal Regulations (CFR) 63, Subpart U; Offsite Waste and
Recovery Operations, 40 CFR 63, Subpart DD; Shipbuilding and
Ship Repair (Surface Coating), 40 CFR 63, Subpart II; Printing
and Publishing, 40 CFR 63, Subpart KK; and Group IV Polymers
and Resins, 40 CFR 63, Subpart JJJ. The proposed rules would
also incorporate by reference changes that the United States
Environmental Protection Agency has made to the following
previously adopted MACT standards: General Provisions, 40
CFR 63, Subpart A; Synthetic Organic Chemical Manufacturing
Industry, 40 CFR 63, Subpart F; Synthetic Organic Chemical
Manufacturing Industry for Process Vents, Storage Vessels,
Transfer Operations, and Wastewater, 40 CFR 63, Subpart G;
Organic Hazardous Air Pollutants for Equipment Leaks, 40 CFR
63, Subpart H; Certain Processes Subject to the Negotiated
Regulation for Equipment Leaks, 40 CFR 63, Subpart I;
Chromium Emissions from Hard and Decorative Chromium
Electroplating and Chromium Anodizing Tanks, 40 CFR 63,
Subpart N; Gasoline Distribution Facilities, 40 CFR 63, Subpart
R; Halogenated Solvent Cleaning, 40 CFR 63, Subpart T;
Secondary Lead Smelting, 40 CFR 63, Subpart X; Petroleum
Refineries, 40 CFR 63, Subpart CC; and Aerospace
Manufacturing and Rework Facilities, 40 CFR 63, Subpart GG.
Finally, the proposed rules would correct the federal promulgation
dates for two previously adopted MACT standards which contain
