Bexar County 2015 Eight-Hour Ozone Standard Moderate Nonattainment Area Reasonably Available Control Technology (RACT) State Implementation Plan (SIP) Revision

On April 24, 2024, the commission will consider adoption of the Bexar County 2015 Eight-Hour Ozone Standard Moderate Nonattainment Area RACT SIP Revision (Non-Rule Project No. 2023-132-SIP-NR). The SIP revision includes RACT analysis to address moderate nonattainment area requirements for RACT mandated by federal Clean Air Act.

The SIP revision also incorporates revisions to 30 Texas Administrative Code Chapter 115 rulemaking (Rule Project No. 2023-116-115-AI) and 30 Texas Administrative Code Chapter 117 rulemaking (Rule Project No. 2023-117-117-AI), to address RACT requirements for volatile organic compounds and nitrogen oxides.

Proposed Bexar County 2015 Eight-Hour Ozone Standard Moderate Nonattainment Area RACT SIP Revision

On November 29, 2023, the commission approved proposal of the Bexar County 2015 Eight-Hour Ozone Standard Moderate Nonattainment Area RACT SIP Revision (Non-Rule Project No. 2023-132-SIP-NR). The proposed SIP revision includes a RACT analysis to address federal Clean Air Act RACT requirements for the moderate classification.

The proposed SIP revision also incorporates the proposed revisions to 30 Texas Administrative Code Chapter 115, Control of Air Pollution from Volatile Organic Compounds (Rule Project No. 2023-116-115-AI) and 30 Texas Administrative Code Chapter 117, Control of Air Pollution from Nitrogen Compounds (Rule Project No. 2023-117-117-AI).

The public comment period opened on December 1, 2023 and closed on January 16, 2024. A public hearing was held for the proposed SIP revision on January 9, 2024 at 7:00 p.m. in the Alamo Area Council of Governments board room, located at 2700 NE Loop 410, Suite 101, San Antonio, Texas.

Bexar County Inspection and Maintenance (I/M) SIP Revision

On November 29, 2023, the commission adopted the Bexar County I/M SIP Revision (Non-Rule Project No. 2022-027-SIP-NR). The SIP revision will implement a vehicle I/M program in the Bexar County 2015 eight-hour ozone National Ambient Air Quality Standard (NAAQS) nonattainment area by no later than November 1, 2026.

The SIP revision also incorporates the 30 Texas Administrative Code Chapter 114, Control of Air Pollution from Motor Vehicles rulemaking (Rule Project No. 2022-026-114-AI) relating to the expansion of the existing I/M program into the Bexar County 2015 ozone NAAQS nonattainment area.

Proposed Bexar County I/M SIP Revision

On May 31, 2023, the commission approved proposal of the Bexar County I/M SIP Revision (Non-Rule Project No. 2022-027-SIP-NR). The proposed SIP revision would implement a vehicle I/M program in the Bexar County 2015 eight-hour ozone NAAQS nonattainment area by no later than November 1, 2026. The associated proposed 30 Texas Administrative Code Chapter 114, Control of Air Pollution from Motor Vehicles rulemaking (Rule Project No. 2022-026-114-AI) expands the existing I/M program into the Bexar County 2015 ozone NAAQS nonattainment area.

The public comment period opened on June 2, 2023 and closed on July 17, 2023. A public hearing was held for the proposed SIP revision on July 13, 2023 at 7:00 p.m. at the Alamo Area Council of Governments, 2700 Northeast Loop 410, Suite 101, San Antonio, Texas.

Proposed Bexar County Moderate Area Attainment Demonstration (AD) SIP Revision for the 2015 Eight-Hour Ozone NAAQS

On May 31, 2023, the commission approved proposal of the Bexar County Moderate Area AD SIP Revision for the 2015 Eight-Hour Ozone NAAQS (Non-Rule Project No. 2022-025-SIP-NR). The proposed SIP revision includes a photochemical modeling analysis, a weight of evidence analysis, a reasonably available control measures analysis, motor vehicle emissions budgets for 2023, and a contingency plan.

The public comment period opened on June 2, 2023 and closed on July 17, 2023. A public hearing was held for the proposed SIP revision on July 13, 2023 at 7:00 p.m. at the Alamo Area Council of Governments, 2700 Northeast Loop 410, Suite 101, San Antonio, Texas.

Proposed Bexar County Moderate Area Reasonable Further Progress (RFP) SIP Revision for the 2015 Eight-Hour Ozone NAAQS

On May 31, 2023, the commission approved proposal of the Bexar County 2015 Eight-Hour Ozone Moderate Area RFP SIP Revision for the 2015 Eight-Hour Ozone NAAQS (Non-Rule Project No. 2022-024-SIP-NR). This proposed SIP revision would demonstrate progress toward attainment of the 2015 ozone NAAQS using reductions of nitrogen oxide (NOX) and volatile organic compound (VOC) emissions for the Bexar County 2015 ozone NAAQS moderate nonattainment area for the 2023 attainment year as well as the 2024 contingency year. This proposed SIP revision would also provide motor vehicle emissions budgets for the 2023 attainment year.

The public comment period opened on June 2, 2023 and close on July 17, 2023. A public hearing was held for the proposed SIP revision on July 13, 2023 at 7:00 p.m. at the Alamo Area Council of Governments, 2700 Northeast Loop 410, Suite 101, San Antonio, Texas.

Bexar County 2015 Eight-Hour Ozone Nonattainment Area Federal Clean Air Act (FCAA), §179B Demonstration SIP Revision

On July 1, 2020, the commission adopted the Bexar County 2015 Eight-Hour Ozone Nonattainment Area FCAA, §179B Demonstration SIP Revision (Non-Rule Project No. 2019-106-SIP-NR). The SIP revision demonstrates that the Bexar County marginal ozone nonattainment area would attain the 2015 eight-hour ozone NAAQS by its attainment deadline “but for” anthropogenic emissions emanating from outside the United States. 

Proposed Bexar County 2015 Eight-Hour Ozone Nonattainment Area FCAA, §179B Demonstration SIP Revision

On January 15, 2020, the commission approved proposal of the Bexar County 2015 Eight-Hour Ozone Nonattainment Area FCAA, §179B Demonstration SIP Revision (Non-Rule Project No. 2019-106-SIP-NR). The proposed SIP revision would demonstrate that the Bexar County marginal ozone nonattainment area would attain the 2015 eight-hour ozone NAAQS by its attainment deadline “but for” anthropogenic emissions emanating from outside the United States. 

The public comment period opened on January 17, 2020 and close on February 19, 2020. A public hearing on the proposed SIP revision was held on February 18, 2020 at 2:00 p.m. at the Alamo Area Council of Governments Board Room, 8700 Tesoro Drive, San Antonio.

San Antonio Attains the 1997 Eight-Hour Ozone Standard

On April 2, 2008, the EPA issued final action to designate San Antonio, along with 12 other Early Action Compact areas, as attainment for the eight-hour ozone standard, as the area met all milestones of the EAC program and demonstrated attainment of the 1997 eight-hour ozone standard by December 31, 2007 ( 73 FR 17897 ). The effective date of this final action is April 15, 2008. Additionally, the one-hour ozone standard was revoked for the San Antonio area effective April 15, 2009.

Designating the San Antonio area as attainment for the 1997 eight-hour ozone standard means that there are no further state implementation plan requirements for the 1997 eight-hour ozone standard as long as the area continues to monitor attainment for the standard.
