Proposed DFW 2008 Eight-Hour Ozone Standard Nonattainment Area Reasonably Available Control Technology (RACT) Update State Implementation Plan (SIP) Revision
On April 4, 2018, the commission approved proposal of a revision to the Texas SIP for the DFW nonattainment area for the 2008 eight-hour ozone standard and a voluntary Agreed Order with TXI Operations, LP. The proposed DFW 2008 Eight-Hour Ozone Standard Nonattainment Area RACT Update SIP revision (Non-Rule Project No. 2017-001-SIP-NR) would address the United States Environmental Protection Agency’s final conditional approval of RACT for nitrogen oxides for the DFW 2008 eight-hour ozone standard nonattainment area through a voluntary Agreed Order No. 2017-1648-SIP (Non-Rule Project No. 2018-010-SIP-NR), with TXI Operations, LP.

The commission will hold a public hearing regarding the proposed voluntary Agreed Order and the proposed SIP revision in Arlington on May 10, 2018 at 2:00 p.m. in the Arlington Municipal Building, City Council Chamber, located at 101 W. Abram Street. The public comment period will be from April 6, 2018 through May 11, 2018.
DFW 2008 Eight-Hour Ozone Attainment Demonstration SIP Revision for the 2017 Attainment Year
On July 6, 2016, the commission adopted the DFW 2008 Eight-Hour Ozone Nonattainment Area Attainment Demonstration (AD) SIP Revision for the 2017 Attainment Year (Non-Rule Project No. 2015-014-SIP-NR). This SIP revision includes a photochemical modeling analysis, a weight of evidence analysis, and a reasonably available control measures analysis that reflect a D.C. Circuit Court decision that changed the moderate area attainment deadline for the 2008 eight-hour ozone NAAQS to July 20, 2018 with a 2017 attainment year.

Redesignation Substitute SIP Revision for the DFW One-Hour and 1997 Eight-Hour Ozone Standard Nonattainment Area
On April 27, 2016, the commission adopted the DFW Area Redesignation Substitute SIP Revision for the one-hour and 1997 Eight-Hour Ozone NAAQS (Non-Rule Project No. 2015-002-SIP-NR). The SIP revision formally documents the anti-backsliding obligations for the revoked one-hour and revoked 1997 eight-hour ozone NAAQS and ensures that the substance of the redesignation requirements is met for the DFW area. This redesignation substitute takes the place of a redesignation request and maintenance plan, which the United States Environmental Protection Agency would require for a standard that has not been revoked.

Redesignation Substitute Report for the DFW One-Hour and 1997 Eight-Hour Ozone Standard Nonattainment Area
On August 18, 2015, the TCEQ submitted the Redesignation Substitute Report for the DFW One-Hour and 1997 Eight-Hour Ozone Standard Nonattainment Area to the EPA. This report fulfills the EPA’s redesignation substitute requirements in its Implementation of the 2008 National Ambient Air Quality Standards for Ozone: State Implementation Plan Requirements; Final Rule (80 FR 12264) to lift anti-backsliding obligations for the revoked one-hour and 1997 eight-hour ozone NAAQS by ensuring that specific redesignation requirements are met for the HGB area under the revoked standard. According to EPA’s 2008 ozone standard SIP requirements rule, this redesignation substitute report is based on certain Federal Clean Air Act redesignation criteria and includes: monitoring data showing attainment of the revoked one-hour and 1997 eight-hour ozone NAAQS; a showing that attainment was due to permanent and enforceable emissions reductions; and a demonstration that the area can maintain the standards through 2028 via emissions inventory trends and future emission projections.

DFW Attainment Demonstration and Reasonable Further Progress SIP Revisions for the 2008 Eight-Hour Ozone NAAQS
On June 3, 2015, the commission adopted two two revisions to the Texas State Implementation Plan (SIP) for the DFW nonattainment area for the 2008 eight-hour ozone standard: the DFW Attainment Demonstration (AD) SIP Revision for the 2008 Eight-Hour Ozone Standard (Non-Rule Project No. 2013-015-SIP-NR) and the DFW Reasonable Further Progress (RFP) SIP Revision for the 2008 Eight-Hour Ozone Standard (Non-Rule Project No. 2013-014-SIP-NR). The AD SIP revision incorporates revisions to 30 Texas Administrative Code Chapters 101, 115, and 117.

Update: The 2017 Wise County RFP demonstration in the adopted DFW RFP SIP revision used a transfer of excess VOC reductions from the nine-county area previously designated as nonattainment to the newly designated Wise County. Upon notification that the option to transfer creditable VOC reductions between county groups was no longer available per the EPA's final 2008 Ozone Standard SIP Requirements Rule (80 FR 12264) , the TCEQ corrected the adopted DFW RFP analyses to remove the VOC reduction transfer and credit emission reductions from drilling rig controls that were available but had not been credited. The corrections were submitted to the EPA in an April 22, 2016 technical supplement.
Request for Determination of Attainment of the 1997 Eight-Hour Ozone Standard for the Houston-Galveston-Brazoria (HGB) and Dallas-Fort Worth (DFW) Areas
In a letter dated February 27, 2015, the TCEQ requested that the United States Environmental Protection Agency (EPA) issue a determination of attainment, also known as a clean data determination, for the 1997 eight-hour ozone National Ambient Air Quality Standard (NAAQS) for the HGB and DFW nonattainment areas. Under 40 Code of Federal Regulations (CFR) §51.918 as well as proposed CFR §51.1118, an EPA determination that an area is attaining the 1997 eight-hour ozone NAAQS suspends certain state planning requirements related to attainment of the standard. This determination of attainment request is based on complete, quality-assured, certified ambient air monitoring data that show the HGB and the DFW areas have monitored attainment of the 1997 eight-hour ozone NAAQS for 2012 through 2014. The HGB area monitored attainment of the standard with an 80 parts per billion (ppb) design value and the DFW area with an 81 ppb design value. The 2014 Annual Data Certification was submitted to the EPA on February 27, 2015.
Emissions Inventory (EI) SIP Revision for the 2008 Eight-Hour Ozone Standard for the Houston-Galveston-Brazoria (HGB) and Dallas-Fort Worth (DFW) Areas
On July 2, 2014, the commission adopted the EI SIP revision for the 2008 Eight-Hour Ozone Standard (Non-Rule Project No. 2013-016-SIP-NR). This SIP revision satisfies the Federal Clean Air Act (FCAA), §172 and §182 requirements for the HGB and DFW nonattainment areas under the 2008 eight-hour ozone standard. The SIP revision includes 2011 emissions inventories for ozone precursors (volatile organic compounds and nitrogen oxides) from point, area, on-road mobile, non-road mobile, and biogenic emissions source categories as the base year emissions inventories for the HGB and DFW areas.

Public Information Meeting: Eight-Hour Ozone Planning for the DFW Area
The TCEQ held a public information meeting to provide information on the development of revisions to the state implementation plan (SIP) for the 2008 ozone NAAQS in the 10-county DFW nonattainment area on Thursday, September 5, 2013 at 10:00 a.m. at the North Central Texas Council of Governments (NCTCOG) offices. NCTCOG and United States Environmental Protection Agency representatives also provided updates on local and federal initiatives.
