Programs Requiring Financial Assurance
Title 30 Texas Administrative Code (30 TAC), Chapter 37 contains financial assurance requirements for all the programs listed below. Common elements of each program are grouped together in Subchapters A-G.
It may be easiest to start out in the specific Subchapter that pertains to your program (e.g. Municipal Solid Waste Facilities or Underground Injection Control Wells). This program Subchapter will explain which portions of the common requirements listed in Subchapters A-G apply.

Insurance Notice - Insurance is a financial assurance option that can be used in many different waste programs for different purposes. Recent legislation has changed the way owners and operators using Insurance as their financial assurance choice must provide evidence to TCEQ of that coverage. Before placing new insurance coverage or renewing it, we recommend:
- contacting the Financial Assurance Unit at (512)-239-0300 to understand the insurance proof methods for your situation, and
- making sure your insurer will be able to provide that proof.
This is particularly important for closure insurance provided for the Industrial Hazardous Waste, Municipal Solid Waste, Recycling, Underground Injection Control, Used Oil and Quarry programs.
TCEQ has accommodated the recent legislation by developing an Endorsement form to replace the Certificate previously used for these programs. We are unable to accept a Certificate of Insurance as proof of closure insurance for these programs.
